Property owners vote from their mobile phones, in the room or connected remotely. ElectIQ instantly calculates the double majority by ownership quotas.
What the law says

In Catalonia, homeowners' associations (communities of property owners) are governed by the Fifth Book of the Civil Code of Catalonia, rather than the Spanish national Horizontal Property Act.

  • Notice of meeting. It may be delivered by email. The ordinary general meeting must be convened with at least eight days' prior notice (Article 553-21).
  • Remote attendance. Owners can attend the meeting via videoconference or other telemetric media if provided for by the bylaws or approved by the general meeting (Article 553-22).
  • Proxy voting. Proxy representation must be granted in writing and specifically for each meeting (Article 553-24).
  • Double majority. Resolutions require both a majority of property owners and, simultaneously, a majority of participation quotas (Article 553-25).
  • Absentee voting. For resolutions requiring unanimity or qualified majorities, absent owners who, once notified, do not formally object within one month are counted as having voted in favor (Article 553-26).

ElectIQ does not replace the meeting. It is the voting tool: the meeting is convened and conducted as usual—in person, by videoconference, or both at once.

How it works
  1. Upload the census. Upload the list of property owners along with each unit's participation quota.
  2. Set up the ballot items. Create one for each agenda item: budgets, renovation work, appointment of officers, or special assessments.
  3. Vote during the meeting. Owners vote from their mobile phones, whether attending in the room or remotely. Proxies are registered before voting begins.
  4. Instant results for the minutes. ElectIQ instantly computes the majority of owners and quotas, clearly displaying who voted in favor, against, or abstained.
WHY ELECTIQ
Quota-weighted voting

No spreadsheets or manual counting errors.

Automatic double majority

See immediately whether a resolution passes.

Open or secret voting

By default, voting is nominal/open, as required for the official minutes. If the meeting agrees, specific items can be voted on by secret ballot.

Audit log

Each vote is recorded in an immutable log, protecting against legal challenges.

FREQUENTLY ASKED QUESTIONS

Is mobile voting legally valid during the meeting?
Yes. The votes are cast by property owners attending the meeting, either in person or remotely. ElectIQ simply tabulates the votes and generates a verifiable record.
Do all owners need to have a smartphone?
No. Anyone without one can vote by a show of hands in the room, and the secretary enters their vote into the system. You can also provide a dedicated tablet in the meeting room.
What happens with absent property owners?
For resolutions requiring unanimity or qualified majorities, the minutes must be formally served to absentees. They have one month to object. If they do not, their vote is counted in favor.
Who drafts the minutes?
The secretary or property manager, as usual. ElectIQ provides the breakdown for each agenda item, including individual votes and their corresponding quotas.
Can owners in arrears with community fees vote?
Under the Civil Code, owners with overdue community debts at the time of the meeting are deprived of voting rights. You can mark them directly in the census before starting.
Does it work for communities outside Catalonia?
This page explains the Catalan regulatory framework. The rest of Spain is governed by the national Horizontal Property Act, which has different rules. Contact us to discuss your options.
